By agreeing to accept or purchase any artwork/characters from me, clients agree to all terms listed on this page unless explicitly discussed and agreed upon otherwise.In artwork purchased involving multiple owners of individual characters, these terms apply to the purchaser and any other individuals who monetarily contribute to the purchase of said artwork. Upon agreeing to any purchases, the buyer also agrees and affirms that they are at minimum 18 years of age. I do not do business directly with anyone under 18. Adults may purchase content as a gift/minors may ask an adult to work with me on their behalf, but I will not do business with a minor directly.

I reserve the right to refuse any commission for any reason. This includes but is not limited to rude or inappropriate behavior, poor ability to communicate, suspected character theft, or any other reason I see fit.

Prices listed on advertisements do not include any potential fees, so please expect to pay an additional ~$3-5+ in processing. I currently only accept PayPal through either Artistree or VGen, with certain exceptions for Artistree made at my discretion. More information on this can be found in the "Payment" section of this page.

For the duration of work done on the purchased image, the client will receive consistent progress updates. No work will continue on the commission until progress is approved/any potential edits are requested. Any revisions needed before the rough lineart/rough color phases will be free of charge, but after this point revisions may incur additional fees. More information on this can be found in the "Commission Process and Delivery" section of this page.

I reserve the right to change my Terms of Service, as well as commission prices, at any time. Should this page or prices be changed during the commission process with the client, the terms listed here at the time of payment are the ones that will apply to the purchase.

I reserve the right to showcase any purchased artwork for marketing purposes. Display of time-sensitive purchases, such as those intended for birthdays, holidays, etc., can be postponed until a specific date upon request. Commissions intended to stay private indefinitely will not be accepted, but client may request to remain anonymous publicly.

Any attempt to purchase NSFW content for a minor, falsifying age to make purchases, or other undermining of my wish to not do business with minors will result in a blacklist for all involved parties.

I retain all rights to purchased artwork, as well as the ability to alter images for marketing purposes. Purchase of image rights can be negotiated. I will NOT negotiate image rights for NFTs or other cryptocurrency purposes. You are NOT allowed to use any artwork I have created or posted for any AI or NFT purposes.

You the client retain all rights to the character(s) depicted in purchased artwork. This does not mean you or any other character owners own the copyright to the purchased artwork.

Unless commissioned with the explicit purpose of utilizing my artwork for the client’s monetary gain, via merchandising or other commercial purposes, the client is not allowed to use my artwork for their own monetary gain. This includes image packs, stickers, or other merchandise depicting the purchased artwork in a promotional manner.

Artwork purchased from me explicitly for advertisement purposes must have commercial rights discussed first. This includes Youtube thumbnails, Vtuber/streaming assets, or any other instance where you would be frequently reposting the artwork for promotional purposes.

Clients are allowed to utilize the purchased artwork for personal use or gifts. The client or any recipient of the artwork as a gift may alter it for profile pictures, wallpapers, or other non-commercial use provided I am appropriately credited on any social media the artwork is used on.

Reposting my artwork is heavily discouraged, but in the event you would like to share artwork purchased from me on a social media I do not have, please remember to provide appropriate credit. If I have the social media you would like to share to, please wait for me to post it myself instead, with the exception of Toyhou.se.

While I do permit editing commissioned artwork for personal use, I do not permit the removal of credit on my work; this includes linked credits on Toyhou.se, watermarks, or any other identification. Artwork in which a watermark will be a notable detriment to the product (ex: advertisement, transparent exports,etc) may lack a watermark but still require appropriate credit.

For rights related to custom character designs, please refer to the adoptable ToS.

Commissions may be requested via form submission (Artistree, VGen) or invoice (discussion via DMs). I recommend you have at least one alternate form of communication if submitting a form.

If you require specific dimensions, file types, resolution, or other formatting, please include it in your request. By default, I work at a resolution of 72 in Clip Studio/deliver final exports as pngs.

Please stick to one platform for communication throughout the commission process. Check your email frequently if you placed your order through Artistree's form system, as its notifications are entirely email based.

Depending on the complexity of the commission, particularly in cases where the character(s) featured have a very complicated design, the commission may be subject to a complexity fee. You will be notified of said fee at the beginning of the commission process, and such a fee may increase throughout production.

Throughout the commission process, the client may suggest any revisions or changes as they wish. Revisions to the initial idea or concept agreed upon may be done during the rough sketch stage, though smaller adjustments, such as limb repositioning or clothing alterations, may be done at any time. Major changes requested after the rough lineart/rough color phases may incur a fee at my discretion.

Please make sure to request any changes before the completion of the final product. I will make minor alterations as needed, but any major adjustments will likely incur a fee if they are not refused at this point.

Final exports are not provided until a low resolution copy of the finished product is approved and any outstanding fees are resolved. For invoiced clients I typically provide final files through DMs, but you may request email delivery instead.

Completion times provided on Artistree/Trello are estimates; I will attempt to complete your commission within the provided timeframe, but if you need your commission completed by a specific date I ask you to discuss this with me before making a purchase.

Should any fees be incurred during the commission process, you will be made aware of the added charge and it will be totaled once the finished product is complete. Until these fees are paid in full, you will not receive the final files.

All payment is done through PayPal regardless of processing platform; I will request it via Artistree by default, but am temporarily allowing VGen as an alternative at my discretion. Direct PayPal invoice is reserved for individuals whose country is not supported by either platform.

I am not the one that charges/calculates processing fees through Artistree, and as such am unable to do more than provide the generalized estimate. Do not use anything other than the request form or provided invoice to pay; I will not accept payment through PayPal's family&friends option, Ko-Fi, or any other alternative.

Payment plans are available for any purchase of $70 or more. Please contact me about payment plans before submitting a commission form/before invoices are sent.

Commission payments are typically due within two weeks of the client confirming and agreeing to their commission. No work will take place on purchased artwork until payment of some kind is received.

Holds/extensions to the payment period may be granted upon request. Should payment not be received, I reserve the right to cancel the commission, after which the client may need to resubmit a commission form/discuss the purchase again.

Should the client cancel their commission after payment and no progress past any potential thumbnails has been made, you will receive a full refund.

Should the client cancel their commission after the initial payment is made, but no work has begun past the sketch phase, they will receive a 90% refund. Sketch commissions are only applicable for a 50% refund after work has begun.

50% refunds will be issued on commissions cancelled at the rough line/rough color stages, but no refunds will be issued past this point.

I reserve the right to cancel a commission at any stage in production. Should I choose to do so, you will be refunded the full cost regardless of what stage the artwork is currently in.

Any revision/alteration fees incurred before cancellations will be waived. Only the initial charge will be refunded, if applicable.

Should a commission be canceled before completion, the client may keep any artwork given to them up to that point in production. Image rights of these artworks are non-negotiable, and any work done on a canceled commission may be recycled for future use by me.

Characters may be regifted/retraded/resold so long as the resale value does not exceed the price paid. You may resell them for greater value once additional art has been added to the character.

You can make whatever content you like with the character after acquisition, I have no intention of policing anything other than commercial use.

Do not remove credits on a character you receive from me. If the character is featured on large projects (namely games, animatics, or any other project you would put credits on), please credit me as the designer. If the character is uploaded to Toyhou.se, do not remove me as the designer or prevent me from seeing the character.

You are free to make reasonable alterations to a character or give it an alternate form (such as a humanoid form for a feral design, adding scars, etc).

Should a purchased character be so heavily altered/changed after purchase to the point that the original design is no longer recognizable, I retain the right to potentially remake the original design for future sale and/or take elements of it to incorporate into new characters. If multiple designs are made for a custom, I may also revise concepts rejected by the client for future sale.

I will make no attempt to take a character from you or resell a previously sold design if usage terms are broken, but it will likely result in you being blacklisted. Knowingly giving characters to blacklisted users will result in you being blacklisted as well.

Characters acquired freely (via raffles, giveaways,etc) do not have any included commercial rights unless otherwise stated. You may do what you like with your character so long as it is not for profit, but will have the option to negotiate purchase of partial or full commercial rights.

While I tentatively allow limited commercial use of designs, I reserve the right to request the purchase of commercial rights before the character is utilized at any time. Buyers must ask permission before utilizing characters for any monetized works, and must credit me as the designer. The limited use listed here is intended to be a guideline, and may be altered on a case by case basis.

Any monetized content the client benefits monetarily from must be created exclusively by the buyer; you may not commission artwork of the character with the intent of commercial use without purchase of full rights first.

Clients do not need to ask before putting content involving the character behind Patreon/Ko-Fi/etc paywalls, so long as the only paywall involved is the associated membership/subscription fee.

While characters may have background appearances in large projects such as comics or games, clients may not use the character as a prominent role in any large for-profit project without permission/full rights purchase.

Any involvement of the character in VTubing, streaming, or mascot/advertising purposes will require the purchase of full commercial rights.

Adoptables must be paid for within two weeks of claiming the design or winning an auction/OTA. Extensions/holds may be granted on request, but failure to respond to prompts for payment or delay will result in the adopt going back up for sale.

Flatsale adoptables are non-refundable unless being purchased via payment plan, in which case a full refund will be issued. If purchasing a custom, please refer to my commission ToS's refund/cancellation section.
